Attention: New Jersey Tobacco and Electronic Smoking Devices Retailer

In 2017, State law increased the minimum age for the sale of tobacco products and electronic smoking devices from 19 to 21. It is a violation of the New Jersey tobacco law to sell tobacco products and electronic smoking devices to a person under the age of 21. The State enforces this law through unannounced inspections with violations resulting in graduated fines of $250, $500 and $1,000. Multiple violations of this law may result in the suspension or revocation of your license.

Avoid Illegal Sales - Train Your Staff to:

  • Look directly at each person attempting to purchase tobacco products and electronic smoking devices over the counter or from a vending machine; and
  • See what the person looks like in detail. Do not guess a person’s age. If you think the person might be underage, request photo ID; and
  • Check the birth date on the photo ID. If the person is under the age of 21, or if doubt exists about the age or ID, or if the person does not present ID, refuse the sale.
  • The best practice recommendation is to ID everyone that is trying to purchase a tobacco products and electronic smoking devices.
